Initial Comments:

Based on the findings of an onsite unannounced home care agency state re-licensure survey conducted on March 15, 2022, Seniors Helping Seniors, was found to be in compliance with the requirements of 28 Pa. Code, Health Facilities, Part IV, Chapter 51, Subpart A.

Based on the findings of an onsite unannounced home care agency state re-licensure survey conducted on March 22, 2022, Seniors Helping Seniors, was found to not be in compliance with the requirements of 28 Pa. Code, Health Facilities, Part IV, Chapter 611, Subpart H. Home Care Agencies and Home Care Registries.

611.51(b) LICENSURE
Direct Care Worker Files

Name - Component - 00
Files for direct care workers employed or rostered shall include documentation of the date of the face-to-face interview with the individual and of references obtained. Direct Care Worker files also shall include other information as required by § 611.52, § 611.53, if applicable, § 611.54, § 611.55 and § 611.56 (relating to criminal background checks, child abuse clearance, provisional hiring, competency requirements; and health evaluations).

Observations:


Based upon personnel file (PF) review and interview with the agency Administrator, it was determined that the agency failed to ensure documention of verification of two satisfactory references prior to hire for six (6) out of seven (7) personnel files reviewed (PF#1- PF#3, PF#5-PF#7)

Findings include:

PF#1-PF#7 were reviewed on 3/15/2022 from approximately 10:00 AM - 11:00 AM, revealing the following:

PF#1:Date of hire (DOH): 2/11/2021: No documentation of verification of two satisfactory references.

PF#2 :DOH: 9/22/2021: No documentation of verification of two satisfactory references.

PF #3: DOH: 8/25/2021: No documentation of verification of two satisfactory references.

PF #5: DOH: 8/18/2021: No documentation of verification of two satisfactory references.

PF#6: DOH: 8/26/2021: No documentation of verification of two satisfactory references.

PF#7: DOH: 10/09/2021: No documentation of verification of two satisfactory references.


An interview with the agency administrator on 3/15/2022 at approximately 11:00 AM confirmed the above findings.






Plan of Correction:

All files have been audited. 9 of about 90 active caregivers were missing date of reference checks. The date of the reference checks could not be recalled, so the references were checked again and dated (with recent dates).

Employee handling reference checks was not properly trained on the date documentation requirement. New hire reference dates are now reviewed by the owner.




611.55(a) LICENSURE
Competency Requirements

Name - Component - 00
Prior to assigning or referring a direct care worker to provide services to a consumer, the home care agency or home care registry shall ensure that the direct care worker has done one of the following: (1) Obtained a valid nurse ' s license in this Commonwealth;
(2) Demonstrated competency by passing a competency examination developed by the home care agency or home care registry which meets the requirements of subsection (b)and (c).
(3) Has successfully completed one of the following:
(i) A training program developed by a home care agency, home care registry, or other entity which meets the requirements of subsection (b) and (c).
(ii) A home health aide training program meeting the requirements of 42 C.F.R. 484.36 (relating to the Conditions of Participation; Home Health Aide Services).
(iii) The nurse aid certification and training program sponsored by the Department of Education and located at www.pde.state.pa.us.
(iv) A training program meeting the training standards imposed on the agency or registry by virtue of the agency ' s or registry ' s participation as a provider in a Medicaid waiver or other publicly funded program providing home and community based services to qualifying consumers.
(v) Another program identified by the Department by subsequent publication in the Pennsylvania Bulletin or on the Department ' s website.

Observations:


Based on personnel file (PF) review, it was determined the agency failed to ensure the direct care worker to have completed a satisfactory competency prior to assignment for three (3)out of seven (7) PF's reviewed (PF#1, PF#3, PF#5).

Findings include:

PF#1-PF#7 were reviewed on 3/15/2022 from approximately 10:00 AM - 11:00 AM, revealing the following:

PF#1:Date of hire (DOH): 2/11/2021: No documentation of a satisfactory competency.

PF #3: DOH: 8/25/2021: No documentation of a satisfactory competency.

PF #5: DOH: 8/18/2021: No documentation of a satisfactory competency. PF included a multiple choice test that was not graded or dated.

An interview with the agency administrator on 3/15/2022 at approximately 11:00 AM confirmed the above findings.








Plan of Correction:

A reporting tool in our online competency exam account was used to verify that all active employees have completed the competency exam - with a few exceptions - annual exams that were recently due, but employees had not yet responded to reminders. Those exams are now complete.

Please note that the owner had difficulty finding the reporting tool during the onsite audit.

The exam is verified to include all 16 subject areas of Chapter 611.
